Terms of Service

Please read our policy carefully

This policy represents the Terms of Service in its entirety and will be applicable to all your transactions as a 'Customer' with 'PrivateAlps.net' as a whole. This policy supersedes any oral promises made by PrivateAlps.net or its staff. If you as a customer have reached an agreement with any of PrivateAlps.net's official representatives, please make sure they are provided in writing; else they will not be considered valid. Please read these terms of service in entirety and carefully before you buy any of our service(s). By buying any of our service(s) you expressly imply that you are bound by the terms listed herein.

General definitions: 'We', 'Us', 'Provider', 'Company' or 'PrivateAlps' represent PrivateAlps.net. 'You', 'Your', 'Client', 'Customer' and 'Member' represent a person or entity who buys services from us.

Content storage and backup policy: All the contents stored on our server(s) by the customer(s) are at the sole risk of customer(s) and PrivateAlps does not have any liability towards keeping the backups of such content. It is the responsibility of the customer to take regular backups of the content stored on the server(s), but we offer backup services as an upgrade to your services, available when ordering your services

Service Delivery: Virtualized services, such as VPS, RDP, and Pentesting Workstations, are provisioned automatically within 2 to 10 minutes, except in cases of stock unavailability, services such as Dedicated Servers (bare-metal), Storage VPS, and GPU Servers are provisioned manually. Following successful payment, delivery may take between 24 to 48 hours.

Cancellations: If your service is not renewed by its due date, a grace period of 3 days is granted to allow for manual renewal. Please note that during this 3-day grace period, if your account does not have sufficient credit and you top up your balance during this time, you will need to manually renew the service by visiting the contract page and clicking the 'Renew' button at the bottom. If the service is not renewed within the 3-day grace period, it will be suspended. From that point, you will have an additional 24 hours to contact us and add the necessary credit for manual renewal. Failure to do so may result in permanent termination of the service. Restoring any lost data is absolutely not possible.

Payment disputes, chargebacks and refund: All payments for services or fund deposits are final. We do not refund, never. In some cases of non-fonctional services, refund in terms of credit which can be used for later purchases can be made, the remaining credit balance in your account is non-withdrawable and non-refundable. Depending on the case we might aswell make a fund refund back to payement wallet. All cases are decided by admin and you need to open a ticket for any trouble.

Limitation of liability: PrivateAlps cannot be held liable for any indirect, incidental, punitive, disruptive or other consequential damages including but not limited to loss in profits, damages related to corruption or deletion of files/website contents, e-mail data and database contents arising out of or in relation to this agreement or your use or inability to use PrivateAlps's services due to any reason regardless of whether the customer is in contract or not even if we are informed/advised of any such possible damages in advance.

Amendments to terms of service: PrivateAlps may, at its sole discretion, without any prior notice amend/modify this agreement from time to time as it may deem fit. Modified Terms of Service will be placed on the website PrivateAlps.net and those terms will come into force immediately for all existing and future customer(s). All previous terms would be superseded in such cases.

Termination of Service

PrivateAlps reserves the right to terminate your access to an individual server or the entire Service at any time. Examples of when your access may be terminated include :

Breaking PrivateAlps's Acceptable Usage Policy (detailed below) / Network policy

In the event of a payment dispute or chargeback

If continued access to your server is preventing other PrivateAlps users from using the Service (Resource Hogging)

Your server expires due to nonpayment

Your bandwidth usage far exceeds your stated limit and attempts to correct it with you have failed

Acceptable Usage Policy

PrivateAlps does not monitor the activity on your server, provided that your usage remains in compliance with the following guidelines:

No outgoing E-mail spam or anything that will upset Spamhaus

  • outgoing E-mail spam or anything that will upset Spamhaus
  • hosting, distribution, or promotion of child sexual abuse material (CSAM)
  • illegal drug or weapons sales, or related content
  • involvement in terrorist activities or the promotion of hate speech in any form
  • involvement in any activity that results in the blacklisting of our IPs by organizations such as Spamhaus
  • use of our infrastructure as a source of Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks
  • activity that disrupts, interferes with, or negatively impacts the performance or stability of our infrastructure or other clients

Deposits and Dedicated Server Delivery

With PrivateAlps's Deposit system, please make sure to send the correct amount if less than the desired amount is sent the system will automaticly detect the payment as lower and credit to the lower decimal.

Please think before making a deposit, you won't get a refund if you choose to not buy.

If there is an issue with your deposit, please send us a ticket containing your bitcoin transaction ID.

Bare-Metal Server Provisioning Policy :

Orders for bare-metal servers placed between Sunday and Thursday will typically be provisioned within 24 hours. Orders placed on Friday or Saturday will be provisioned by the following Monday. In certain cases, provisioning may be delayed due to complex configurations (e.g., high memory requirements, 10Gbps or 40Gbps network interfaces, or custom setups). If your order is affected by such a delay, you will be notified by email so that you can relay this information to your own customer if applicable. We make every effort to minimize delays and, in many cases, we are able to deploy servers faster than the standard lead time — particularly when hardware matching the order specifications is already preassembled. We recommend submitting your order as early as possible to help ensure timely delivery.

Affiliate program

The partner bonus are paid up to four days after the payment of a service by the referred customer and is confirmed. The commission amount (percentage) for a referred customer is specified in the following web page: Affiliate Dashboard Affiliates must not use their own referral link to buy services for themselves. If violations are discovered, all accounts will be frozen and commissions cancelled. All bonuses can be paid upon request after reaching at least 25 EUR amount or any bonus can always be used to fully or partially pay services at privatealps.net.
